Alot of our clients ask us the question, “What are ALTA surveys and why are they needed?”  We hope to answer this question here:

An ALTA Survey is:

A land survey is made for the Title Company and/or Lender with the survey and location data needed for the issuing of title or mortgage insurance. For this purpose a map is drawn to “ALTA” specifications. “ALTA” stands for American Land Title Association.

ALTA specifies the data to be shown on the survey and this includes boundary lines, location of the main building including improvements, location of ancillary buildings, the identification of easements (access rights by service companies such as water, gas, telephone, railways and other utilities). ALTA surveys are very complex surveys and can cost tens of thousands of dollars and take weeks to complete. For that reason most ALTA surveys are performed on commercial properties.

An ALTA Land Survey guarantees to meet the requirements for an ALTA/ACSM Land Title Survey as detailed by the American Land Title Association, National Society of Professional Surveyors and the American Congress on Surveying.

We have the capability and know how to perform the following water right functions:

Utah Well Proof -

A Proof of Beneficial Use (proof) must be submitted on all applications to appropriate, change applications, and exchange applications. A proof is a sworn statement that describes the constructed diversion and conveyance works and the beneficial use of the water.

The two methods to submit proof are by:

• Proof Professional
  • In many cases proof has to be completed by a professional engineer or licensed land surveyor.
  • Proof forms and other information
  • Proof Professionals List – This list shows Proof Professionals who have attended training sponsored by the Division of Water Rights within the last two years. Proof Professionals DO NOT have to appear on this list in order to be eligible to prepare a Proof of Beneficial Use. The Division of Water Rights does not endorse any specific proof professional. Proof professionals must be licensed in Utah. To check the status of a professional license check with the Division of Occupational and Professional Licensing.
• Affidavit of Beneficial Use
  • Effective May 12, 2009, an applicant, in some cases, may submit an Affidavit of Beneficial Use without having to hire a professional.
  • To be eligible to file an affidavit as proof, the uses must be one residence, a quarter acre of irrigation or less, and ten head of stock or less.

Utah Diligence Claim:

Rights for water diversion and use established prior to 1903 for surface water or prior to1935 for ground water can be established by filing a “diligence claim” with the Division. Such claims are subject to public notice and judicial review and may be barred by court decree in some areas of the state.

All other rights to the use of water in the State of Utah must be established through the appropriation process administered by the Division of Water Rights.

The Division of Water Rights is the state agency that regulates the appropriation and distribution of water in the state of Utah. It is an office of public record for information pertaining to water rights, excepting that related to water right ownership. The office of public record for water right ownership is the county recorder’s office for the county(ies) in which the water is diverted. All official and publicly accessible water right records are available in the Salt Lake City office or from this site. Region Offices outside Salt Lake City will also have copies of most records for the areas they administer.

The Utah pioneers, in the late 1840′s, were the first Anglo-Saxons to practice irrigation on an extensive scale in the United States. Being a desert, Utah contained much more cultivable land than could be watered from the incoming mountain streams. The principle was established that those who first made beneficial use of water should be entitled to continued use in preference to those who came later. This fundamental principal was later sanctioned in law, and is known as the Doctrine of Prior Appropriation. This means those holding water rights with the earliest priority dates, and who have continued beneficial use of the water, have the right to water from a certain source before others with water rights having later priority dates.

In the early territorial days, rights to the use of public streams of water were acquired by physical diversion and application of water to beneficial use, or by legislative grant. A “county courts” water allocation system was enacted in 1852 and was in effect until 1880 when it was replaced by a statute providing for county water commissioners.

The Office of the State Engineer was created in 1897. The State Engineer is the chief water rights administrative officer. A complete “water code” was enacted in 1903 and was revised and reenacted in 1919. This law, with succeeding complete reenactments and amendments is presently in force mostly as Utah Code, Title 73. In 1967 the name of the Office of the State Engineer was changed to the Division of Water Rights with the State Engineer designated as the Director, but the public sometimes still refers to the Division as the State Engineer’s Office.

All waters in Utah are public property. A “water right” is a right to divert (remove from its natural source) and beneficially use water. The defining elements of a typical water right will include:

• A defined nature and extent of beneficial use;
• A priority date;
• A defined quantity of water allowed for diversion by flow rate (cfs) and/or by volume (acre-feet);
• A specified point of diversion and source of water;
• A specified place of beneficial use.

I am very fond of Idaho.  My mother being raised in a small town near Idaho Falls we have had the occasion to visit often.  Osgood, is the little place where she was raised directly West of Idaho Falls.  In fact a large major road in Idaho Falls was named after my Grand father Walter Pancheri.   – We love Idaho.

We offer quick, easy and affordable FHA Manufactured Foundation Inspections.  Being centrally located in Utah, we are able to cover the entire state quite easily.  Below is the process we take for our FHA Manufactured Home Foundation inspections:

1) We finalize the contract of work.  This is done by completing a one page contract helping both us as the service provider and you as the client.

2) Scheduling of Work – This is done immediately at time of contract and payment.  We know of the sensitive time frame of these inspections and desire to meet any time constraints that are placed upon us.  We usually complete these inspections within 48 t0 72 hours after the approved go ahead.

3) Inspection – These inspections are required for a registered professional engineer to visit the home.  We will need access to either the crawl space or the basement if a basement has been built.

4) Letter – After we have visited the house, we write a letter and then provide a stamped copy for you and your mortgage company.
