Well Proofs

All waters in Utah are public property. A “water right” is a right to divert (remove from its natural source) and beneficially use water. The defining elements of a typical water right will include:

  • A defined nature and extent of beneficial use;
  • A priority date;
  • A defined quantity of water allowed for diversion by flow rate (cfs) and/or by volume (acre-feet);
  • A specified point of diversion and source of water;
  • A specified place of beneficial use.

Rights for water diversion and use established prior to 1903 for surface water or prior to1935 for ground water can be established by filing a “diligence claim” with the Division. Such claims are subject to public notice and judicial review and may be barred by court decree in some areas of the state.

A Proof of Beneficial Use (proof) must be submitted on all applications to appropriate, change applications, and exchange applications. A proof is a sworn statement that describes the constructed diversion and conveyance works and the beneficial use of the water.

The two methods to submit proof are by:

Proof Professional

  • In many cases proof has to be completed by a professional engineer or licensed land surveyor.
  • Proof forms and other information
  • Proof Professionals List – This list shows Proof Professionals who have attended training sponsored by the Division of Water Rights within the last two years. Proof Professionals DO NOT have to appear on this list in order to be eligible to prepare a Proof of Beneficial Use. The Division of Water Rights does not endorse any specific proof professional. Proof professionals must be licensed in Utah. To check the status of a professional license check with the Division of Occupational and Professional Licensing.

Affidavit of Beneficial Use

  • Effective May 12, 2009, an applicant, in some cases, may submit an Affidavit of Beneficial Use without having to hire a professional.
  • To be eligible to file an affidavit as proof, the uses must be one residence, a quarter acre of irrigation or less, and ten head of stock or less.

Once a proof or affidavit has been processed the State Engineer will issue a Certificate of Beneficial Use. [1]

Manufactured Home Foundations Inspections

Manufactured Home Foundations Inspections

English: Manufactured home built and ready for...

All foundation systems, new and existing, must meet the guidelines published in the Permanent Foundation Guide for Manufactured Housing (HUD-7584), dated September 1996.  A certification attesting to compliance with this handbook must be obtained from a licensed professional engineer.

It means that the foundation must meet the criteria as set forth in HUD manual Permanent Foundations Guide for Manufactured Housing, September 1996. This manual requires a site specific design for every manufactured home. Dead loads, snow loads, wind loads and seismic loads must all be taken into account. There must be a perimeter, frost line protected strip foundation as well as frost line protected piers under the chassis.

The stacked blocks that the unit actually sits on must not only be mortared, they must be attached with rebar to the footing and bolted and/or welded to the chassis frame, unless there is an alternate, site specific engineered design (which Hayman can provide).  The design must include protection against horizontal shearing forces and uplifting forces. This can require additional strapping between the stacked blocks. Finally, it means that this design must be stamped by a licensed professional engineer verifying that HUD requirements are met.

Ludlow Engineering provides these inspections and reports meeting the FHA and HUD requirements through their licensed Engineer.  Reports are ready immediately after inspection.

Some of the items that are inspected and verified are:

  • Site layout, drainage and flood-prone area identification.
  • Name, address and phone of home manufacturer.
  • Date of manufacture.
  • Date of foundation construction and type of foundation.
  • Building permit and inspection record.
  • Foundation size and tie down placement.
  • Applicable loads on the foundations.[1]

Permanent Foundations For Mobile Homes – HUD 7584 PFGMH Manufactured Home Inspections Guide

When you buy (or sell) a manufactured / mobile home, many times the loan involved in real estate transaction will either be an FHA or VA loan.  However, FHA and VA will only fund the loan if you can prove that the foundation under the home is a permanent foundation.

But what is a “permanent foundation” and where do I find it’s proper definition?  Well, in HUD Publication 7584, is where you will find its definition.  The definition is quite extensive and geared, mainly, towards professional engineers.

The HUD 7584 publication is also called the HUD Permanent Foundation Guide for Manufactured Homes, or PFGMH.  It is published by the United States department of Housing and Urban Development (HUD).  This 400 page manual is intended for new construction of manufactured home permanent foundations. If you have an existing foundation and are in need of a permanent foundation certification, then the existing permanent foundation shall meet the intent of the PFGMH.

A manufactured mobile home foundation that does not meet the intent of the PFGMH is considered non-compliant, and one that does meet the intent of the PFGMH is considered compliant.  Only a professional engineer licensed in the state of where the home is located can make this determination.

In its most simplistic definition, a permanent foundation will generally consist of a skirting to keep out vermin and water, footings and piers to support the home from gravity loads (such as snow and live loads), anchorage to resist lateral loads such as high winds or an earthquake, and other considerations.

The reason why a professional engineer is required to determine whether it is permanent or not, is because of the safety issues involved with a structure that houses people.  Professional engineers have the training and educational background to determine if the foundation is safe and habitable, and also “permanent” as defined by HUD.

Ed Harrison, PE is a licensed professional engineer in a multitude of states across the country and is the owner of Foundation Certifications. He works with mortgage lenders, loan officers, real estate agents, and private parties across the United States with their manufactured home foundations and loans. He is an expert in the field of FHA/HUD/VA compliant manufactured home foundations. His engineering firm provides not only certifications for HUD compliant manufactured home foundations, but they are also a full service civil and structural engineering design firm.
