<p>Several months ago we presented new information about what a <a href="http://www.ludlowengineers.com"  rel='nofollow' >land survey</a> is and who a <strong>land surveyor</strong> really is.  We thought we would share that again today, emphasizing the importance of a <a href="http://www.ludlowengineers.com"  rel='nofollow' >land survey</a> and why people get them.  A <strong>Land survey</strong> is needed for all transactions or development of a parcel of land.  Why?  One needs to understand the extents of the land and how things fall upon it.  A topography is often requested as well and can be done by a land surveyor.  <strong>Call for more information at 435.623.0897</strong>.</p>

<h4><em>What is a boundary survey?</em></h4>
<p>A boundary survey determines the property lines of a parcel of land described in a deed. It will also indicate the extent of any easements or encroachments and may show the limitations imposed on the property by state or local regulations.</p>
<h4><em><a name="when"></a>When is a Land survey needed?</em></h4>
<p>A survey is strongly recommended before buying, subdividing, improving or building on land. Surveying the parcel before these activities ensures that the expense and frustration of defending a lawsuit, moving a building, or resolving a boundry dispute can be avoided.</p>
<h4><em><a name="stan"></a>What does a standard boundary survey entail?</em></h4>
<p>The surveyor thoroughly examines the historical records relating to the land in question and often all lands surrounding it. In addition to the Registry of Deeds this research may include: the Registry of Probate, county commissioners’ offices, town offices, historical associations and the Department of Transportation. The surveyor may also talk with prior owners and adjoiners.</p>
<p>The field work begins after the research and involves establishing a control network of known points called a traverse. The points are used to search for and locate existing monuments and other evidence of the boundaries. Although the field portion of a survey is the most visible phase of surveying, it usually represents only a third of the entire project.</p>
<p>The results of the field work are compared with the research and the surveyor then reconciles all the information to arrive at a final conclusion about the boundaries. A second field trip is then needed to set the new monuments. Finally, the surveyor will draft a plan, prepare a legal description and write a report.</p>
<h4><em><a name="cost"></a>How much does a Land survey cost?</em></h4>
<p>The cost of a boundary survey depends on many variables, some of which can not be known until after the work has started. The size, terrain, vegetation, location and season affect the charges and can usually be estimated fairly accurately. However, the surveyor will not know if deeded monuments are missing or if they conflict with the description until well into the survey.</p>

<p>rtions of the orginal lot. The more outparcels and consolidations there have been, the more complex and costly the research becomes. Many deeds are “abutter deeds” which use the neighbors’ names to define boundaries. In some cases it may be necessary to research parcels far removed from the <em>land being surveyed</em> to assemble the jigsaw puzzle of old deeds and it is not unusual for the research to account for 50% or more of the total survey cost.</p>
<h4><em><a name="result"></a>What are the results of a boundary survey?</em></h4>
<p>Depending on the services agreed on, a boundary survey may produce:</p>
<ol>
<li>Monuments at all property corners</li>
<li>A written description of the property</li>
<li>A plan of the property</li>
<li>A report explaining the basis of decisions and judgements made to determine the boundaries.</li>
</ol>
<h4><em><a name="marked"></a>How will the boundaries be marked?</em></h4>
<p>This also depends on what the client and the surveyor have agreed to. Monuments may include wooden posts, iron pins or pipes, marked trees or concrete monuments. Maine survey standards require that each monument set by a surveyor must clearly show his or her license number. Additionally, you may want to have the surveyor blaze and/or paint trees along the boundary line.</p>

<p>The obvious answer is, when a survey of the property/land/building in question is required which would include positioning and measurements of a building/property or land. The data collected from the survey is then translated into plans where architects or planners can evaluate, enabling them to know how the project might then progress or where problems may occur.</p>

Very few things in the world take as much consideration as how to create a land development. It takes land developers many months to look into past, present and future information to ensure that they have created a sound plan for the environment to develop the land for the purposes the developer needs it to accommodate. </p>
<p>Research is done for land development because each separate project has its own issues and special circumstances that make it unique. Surveyors and Civil Engineers work closely together to look into every possible potential issue to make sure they have a plan for anything that can happen with a land development project. Things such as drainage, ground stability and the other structures surrounding the project are all some of the things that need to be taken into consideration before the shovel breaks ground.</p>
<p>There are steps that land developers must take on their journey into developing a piece of raw land. First, they must spend an ornate amount of time looking into all of the factors that affect a project. They track economic trends to see if investing time and money in to a land development project is profitable. They also look into things like population growth and job growth to determine the growth of an area. This step usually involves many different professionals. Government officials, business members, real estate professionals and builders will meet with a land developer to create a due diligence report. This eliminates all the guess work involved and puts the facts in place to determine the worthiness of a proposed project.</p>
<p>Once developers have found land, determined that an area&#8217;s growth rate is worthy of the proposed project developers will go about negotiating for the acquisition of the raw land. There are two common ways most developers go about this process they are; purchasing the land upfront with cash or negotiating an option to purchase the land by a set date and price by putting a large deposit down. The second option is considered more favorable because it leaves developers funds available for the project at hand. It is unwise to tie up working capital when working on land development projects. </p>
<p>Next land developers draw up architectural plans for approval by local government officials. Whether land is being developed for a sub division, a professional complex, an industrial park or a shopping plaza plans need to be approved by officials and if funding is be acquired by outside investors should also be involved in approving the proposed draft. This step all involves accessing permits by all stages of government that are needed for the developer&#8217;s project to continue smoothly. </p>
<p>Lastly the land will be converted from raw, natural land into what land that has been processed into a state that makes it useful and valuable to the land developer and all participants involved in the process. Builders come in purchase the land and begin turning it into a piece of property that fulfills the need of the surrounding community.</p>
<p>Land development takes a piece of Earth that most people look at as a vacant wasteland without purpose and turns the natural, raw, land into a plot of riches. Developers take on the huge risks involved in land development because of the large reward financially in the end.

<p>For one family, a dream home might be a two-story mansion with columns and marble, while another family in the same town might dream of living in a one-story ranch-style home with breathtaking views. Because building a custom home from scratch can be a time-consuming and costly project, anyone hoping to undertake a project of this magnitude needs to be sure he knows what he is getting himself into before plunging in headfirst. </p>
<p>General Idea of Your Custom Home<br />
For anyone who wants to build a custom home, the first step is to get organized. This means making appointments with architects, surveyors, and general contractors in the Raleigh area, and making sure everyone is on the same page in terms of the homes design and the area of land where it is going to be built. Before you can move forward with building a home, you have to get the land where its going to be built surveyed by a professional. </p>
<p>At the same time, I recommend putting together some ideas of the size, style, and layout you are thinking about for the home. At the very least, you are going to want to have a general idea of the layout you like and the approximate square footage you need before going in to meet with an architect. </p>

Most homes can be turned around within three to five months, but you should definitely check with your contractors to see what their own timelines are, depending on the size of the house, the area, and the season. </p>
<p>Low Country Homes<br />
Among the new homes being built near Raleigh, the latest trend has been to design what are known as low country homes. These homes are known to be particularly popular in the South, and often feature an elevated porch that spans the length of the house to allow homeowners to enjoy as much time as possible outside. When it comes to the interiors of these new homes, kitchen designs have become the biggest focus for many of my clients. We generally try to modify the kitchen designs to better suit the individual or family who is building the home. </p>
<p>Homes Energy Value<br />
One of the hottest topics being brought up by clients in the past year is the homes energy value, specifically in areas like the kitchen and washroom. When we are putting together a new house, we will often try to increase the energy values by installing energy-efficient windows and appliances in the kitchen. </p>
<p>Energy-efficient appliances can sometimes be cost prohibitive, so we have developed a way to save money by cutting back on some non-essential itemssuch as high-end moldings, for exampleand put the saved money toward energy-saving appliances like new HVAC systems. By putting in cheaper moldings, we can also use the saved money on upgraded windows or siding. </p>

<p>1) Can you explain a bit about your background?</p>
<p>I have worked in the property world since graduating from Reading University in 1976 initially in the South Midlands and East Anglia, but for the last 26 years in  the West Country counties of Cornwall, Devon, Somerset and Dorset.</p>
<p>2) What is your definition of value in the current UK property market?</p>
<p>Here is the non technical answer:  the UK property market is a largely open and free market made up of thousands of individual transactions made by people and organisations  with wide-ranging objectives.  A free flow of information in the market is essential in informing the decisions behind those transactions. The internet has revolutionised the availability of information on transactions and has made it accessible to everyone; whereas before only people in the industry had such information. This has enabled many more people to join the property owning community.  Value is what one person will pay to another for a property and, if value is not to be distorted, both parties must be well informed and acting in an arms length relationship.</p>
<p>3) Would it be fair to say that most surveyors are taking a conservative view on the valuation of property due to the uncertainty of the market?</p>
<p>Surveyors base their assessment of value not only on comparable evidence of similar transactions but also on their assessment of current market sentiment from the general public, the volume of properties available and being traded and of course many external factors that bear on the individuals undertaking a property transaction  for example: the general state of the economy, interest rates , taxation policies etc.  If surveyors are taking a conservative view, this should reflect a conservative approach that parties are taking in actual negotiations and transactions and reflecting the uncertainty of the market of which they form part.</p>
<p>4) The majority of investors reading this are residential property buyers  one difficulty that has emerged as a result of the low market activity is the ability to obtain comparable sold data.  What can be undertaken from your point of view to assist with this issue?</p>
<p>Data on property transactions is available through many free websites and through the Land Registry. Statistics on trends are also available free from the Department for Communities and Local Government and indices on house price movements from Halifax Bank and Nationwide Building Society. There are also subscription websites giving additional data which further knowledge about local markets (such as Hometrack&#8217;). Agents are, generally speaking, willing to help with information on transactions in their area provided they are approached tactfully and they are not restricted from giving information on a transaction by confidentiality. The current situation is dramatically better for individual investors than it has ever been and over time it is likely to improve further with the further development of the internet. However when there are so few transactions as we are currently experiencing, it is difficult find comparable evidence. This is a difficulty for professional Valuers as much as the general public. It needs deals to be done to establish the market. In these conditions investors may be taking greater risks as their decisions are less well informed. Property transactions have never been risk free and it may be that, after a long period of a rising market before this recession, some people became too complacent and assumed that their property transactions could not fail.</p>
<p>5)  Can you talk through the processes that you would undertake prior to visiting a property in terms of your own due diligence?</p>
<p>Terms of business must be agreed with the client before visiting the property. Very often the client is pressing to have the advice/ survey/valuation as quickly as possible so that office based research sometimes happens after a visit rather than before. In any case, the Surveyor can target his research more efficiently if he has first visited the property and actually analysed its location. Depending on the purpose of the report, the Surveyor will want to consider most of the following:</p>
<p>- planning consents;</p>
<p>- short, medium and long term planning issues in the area;</p>
<p>- recent works of repair / improvement to the property;</p>
<p>- available consents guarantees;</p>
<p>- boundaries and related responsibilities;</p>
<p>- location and routes of utilities;</p>
<p>- environmental issues;</p>
<p>- contamination issues;</p>
<p>- presence of mines;</p>
<p>- flood risks;</p>
<p>- subsidence risks;</p>
<p>- details of construction if it is non-standard;</p>
<p>Much of this information and more is available through a local Authority search and website enquiries from various organisations.</p>
<p>6) Similarly, if you are requested to undertake a desktop valuation what steps would you take?</p>
<p>Surveyors should be very wary of desktop valuations which can be misleading to the recipient if the basis of the valuation is not properly understood. In general, such valuations should only be undertaken when the property has been previously inspected and preferably not too long before. Such valuations must clearly state the assumptions on which they are made. They are best avoided when a surveyor is dealing with the general public who will probably expect the same level of knowledge of the property as if it had actually been inspected and may feel let down if they subsequently find changed conditions which had not been identified through the lack of an inspection.</p>
<p>7)On the back of the last two questions, do you think residential house prices in the UK are still over-valued?</p>
<p>In my opinion, residential house prices are too high in relation to salary levels  particularly if as a society we wish to encourage a home ownership culture. This is not a fault of the property market, but of external factors that bear on home buyers such as a lack of new homes available to buy thus restricting supply. In an open market such as the property market in the UK, home buyers are competing for the available homes to buy with other types of purchasers such as foreign investors, buy to let investors, holiday home buyers etc. Unless the government intervenes to disadvantage these other types of purchasers (which I would not advocate) they key to reducing prices is to increase the supply of homes on the market.</p>
<p> <img src='http://www.ludlowengineers.com/wp-includes/images/smilies/icon_cool.gif' alt='8)' class='wp-smiley' /> Should residential property investors take more of a value based approach  as is what is more common in commercial property?</p>
<p>If the motive for purchase is property investment then yes, a value based approach is the best advice.  However, when people buy for their own occupation and use they apply many different subjective criteria and will sometimes ignore the rational behaviour of the market and pay in excess of what the property could be resold for. This is a valid part of a diverse open market that sometimes makes it unpredictable for those observing it from a distance.</p>
<p>9) You are a major advocate of regulation of the property  industry  and your book discusses this in detail  what kinds of measures do you think should be in place?</p>
<p>I am an advocate of the proper regulation of individuals working within the property industry particularly to protect the inexperienced general public who occasionally participate. I do not particularly advocate regulation of property itself unless there is a clear need . In many parts of the property industry there is a clear need and obvious benefit from various types of regulation, however in general I feel that there has been excessive and too complex regulation in recent years to the extent that some people ignore areas of regulation or the regulation restricts the market. Regulation should be proportionate to the benefit achieved as well as being simple and straightforward.</p>
<p>10) Is there a difference, in your opinion, between regulation to install professional principles into the industry and the government just sticking their oar in?</p>
<p>Governments are motivated to regulate where they feel that consumers are adversely affected or if the market is acting imperfectly or against policy objectives. Governments are also motivated to find ways to tax property which is a good store of private wealth and an easy target for the raising of public finance. Occasionally, governments will regulate in pursuit of social policy objectives. In general, the government in the UK has not regulated much in pursuit of encouraging professional principles, but rather has relied on the industry self-regulating itself through its professional bodies such as the RICS and NAEA. The Government has resisted the temptation to statutorily regulate Estate Agents which it could have done at any time by using powers in the  Estate Agents Act of 1979.   This means that the professional bodies need to be constantly looking at themselves critically to ensure that they are reflecting public opinion and public concerns by adapting their regulatory arrangements to keep up with best practice.
